Extension of California’s Eviction Protection to June 30, 2021

On January 29th, 2021, California Governor Gavin Newsome signed legislation to extend the state's eviction moratorium through June 30th, 2021. This is an extension of what was established last year under the Covid-19 Tenant Relief Act (AB 3088), which was set to expire at the end of January. The legislation pauses evictions for tenants who declare under penalty of perjury and inability to pay all or part of their rent to their landlord due to a COVID related reason. Tenants are still responsible for paying unpaid amounts to the property owners, but those unpaid amounts cannot be the basis for eviction, even after the moratorium. 

There was also a new state bill introduced at the same time, SB 91, programs to allocate 2.6 billion in federal rental assistance that California is set to receive. Both pieces of legislation continue to address the housing crisis that has been exacerbated by COVID 19. We’ve got a lot to learn about SB 91 and all of its details so this post is intended as a general overview.  We will continue to track new developments and additional aspects about this legislation as they become more clear in the weeks ahead.
