Statewide Framework
State law sets a consistent baseline for security deposits, required notices, habitability, and the eviction process. These rules standardize daily compliance and give investors a predictable framework across every Florida market.
Local Overlays
Unlike states that allow city-by-city rules, Florida preempts most local regulation of the rental relationship to the state. Local rent control is barred except through a narrow, voter-approved housing-emergency process that automatically expires within one year, and no Florida locality has rent control in effect today.
Chapter 83 and State Preemption
The Florida Residential Landlord and Tenant Act, Chapter 83, Part II, governs residential leasing statewide. In 2023, House Bill 1417 strengthened state preemption, centralizing regulation of the rental relationship and setting a uniform 30-day notice to end a month-to-month tenancy. For investors, this means consistent rules statewide rather than a patchwork of local ordinances.
Section 83.49 and Security Deposits
Florida sets no cap on security deposit amounts but enforces strict timelines. When no claim is made on the deposit, it must be returned within 15 days. When a claim is made, the investor must send written notice within 30 days, which makes precise move-in records and disciplined accounting essential.
Section 83.56 and Eviction Notices
For nonpayment of rent, Florida requires a three-day notice to pay or vacate, excluding weekends and legal holidays, before an eviction action can proceed. Exact notice language and timing are critical, and our local teams manage every step to keep possession actions lawful and efficient.
